ANNOUNCEMENT OF THE RECEIVER
The Receiver of the Bankruptcy Estate of Piotr Matuszewski, in case PO1P/GUp-s/352/2023, announces the sale of 1/2 share in the ownership of a residential unit with a usable area of 61.40 m2, including: a hall, 2 rooms, 1 room with a kitchenette, a bathroom with a toilet, a storage room. The premises are located in building No. 9 at Orzechowa Street in Czapury, in the Mosina commune, KW PO1M/00055361/9.
The sale will take place on the terms set out in the Terms and Conditions
The starting price is PLN 93,626.75. (Slovak nine thousand six hundred twenty six zlotys 75/100 gr.).
The selection criterion is the highest price offered, but not less than PLN 93,626.75.
The condition for participation in the tender is to submit a written offer directly to the Office of the Receiver Andrzej Jabłoński, 14/5 Jana Pawła II Street, 62-300 Września or to send it by registered mail to the address of the Receiver's Office by 05.09.2024 (the date of receipt of the offer to the Receiver is decisive).
The opening and examination of the offers will take place at 14/5 Jana Pawła II Street, 62-300 Września at 09:00 on 10.09.2024.
The offer with the required documents should be placed in a closed envelope with the note - DO NOT OPEN TENDER – PIOTR MATUSZEWSKI and must contain the designation of the person submitting the offer.
The purchase offer should include: ref. no. PO1P/GUp-s/352/2023; exact designation of the applicant: name and surname or company name, place of residence or registered office, account number; the offered price expressed in numbers and in words, in the event of discrepancies, the price expressed in words shall prevail.
Individuals provide PESEL numbers. In the case of community of marital property and purchase of real estate from the funds from the joint property, the signatures of both spouses or the consent of one of them expressed in writing with a notarized signature.
Legal persons and entities which are not legal persons, to which the Act grants legal personality and persons conducting business activity, indicate the National Court Register (KRS) or CEIDG; any permits and consents, if required by law or by the agreement of the entity in question; in the case of commercial law companies – a resolution of the relevant authority approving the purchase of real estate.
Each entity is obliged to attach: the bidder's obligation to cover the fees related to the purchase (notary fee, court fees and other taxes and fees); bank account number for the return of the tender deposit; proof of payment of the tender deposit.
The condition for joining the tender is the payment of a tender deposit in the amount of PLN 19,575 to the bank account of the bankruptcy estate: 04 1090 2590 0000 0001 5446 8254, with the note TENDER, all bank fees are borne by the bidder.
The payment of the bid bond must be credited to the bank account of the bankruptcy estate by 05.09.2024 at the latest on the day of submission of bids.

If the Receiver receives at least one offer for the purchase of the property on time, the Receiver or an attorney appointed by him will conduct an auction
The increment cannot be less than PLN 500.
The buyer is obliged to pay the price within 30 days from the date of selection of the offer.
If the bid of a given bidder is selected, the bid bond is credited towards the sale price.
If the bid bond is paid, but the bidder evades concluding the contract or refrains from paying the remaining part of the offered price, the bid bond is forfeited to the bankruptcy estate.
Set-off of the buyer's claims against the bankrupt is inadmissible and ineffective.
The buyer bears all costs and burdens related to the conclusion of the agreement, including in particular the costs of the notarial deed and the costs related to the possible deletion of encumbrances from the land and mortgage register.
The contract will be concluded within 3 months from the date of selection of the bidder, on the date and the Notary's Office indicated by the Receiver.
If the bidder is not selected, the tender deposit shall be returned within 7 days. The refund is made in the form of a bank transfer. No interest is due for the time the bid bond amount remains.
The appraisal report is available at the Receiver's Office, after prior telephone arrangement or can be submitted electronically.

The presentation of the premises will take place after prior telephone arrangement with the receiver.
The property is sold in a single-source mode, however, in the form of a competition of offers.
